The French Council of State suspends the "anti-burqini" regulations

August 28, 2016
The French Council of State, with the 26th of August 2016 ordonnance, suspended the so called "anti-burqini regulation", adopted by the Mayors of several coastal municipalities. The aforementioned regulation banned (although without openly mentioning it) the so called "burqini" (e.g.: by banning beach clothing "incompatible with the secular principle").
The Council of State found that said regulation is "a severe and openly illegal violation of fundamental liberties", such as freedom of movement, freedom of conscience and personal freedom.
It must be noted that the Italian Courts came to the same conclusions as soon as 2014, stating that the regulation introduced by the Mayor of Varallo, which banned the burqini from the municipality due to public health concerns, should be regarded as illegal. The regulation, challenged before the Tribunal of Turin, was found to be discriminatory and incompatible with freedom of religion, and was withdrawn by the Mayor while the case was still pending before the Court.
